Unclaimed & Abandoned Firearms Policy

1. Purpose

This policy establishes Clear Sky Armory’s procedures for firearms that are not retrieved after completion of authorized work or lawful transfer eligibility. The policy is intended to comply with applicable federal law, California law, and regulatory expectations while clearly defining customer responsibilities, fees, and lawful disposition options.

2. Definitions

2.1 Unclaimed Firearm

A firearm is considered “Unclaimed” when:

Authorized work has been completed or the firearm is otherwise ready for lawful return or transfer, and

The owner or authorized transferee has failed to retrieve the firearm within ninety (90) calendar days after notice of completion.

2.2 Abandoned Firearm

A firearm is considered “Abandoned” when it remains unclaimed for one (1) year after being classified as Unclaimed.

3. Notice to Owner

Clear Sky Armory will make reasonable efforts to notify the owner that the firearm is ready for pickup.

Notice may be provided by phone, email, written correspondence, or other documented methods.

All notice attempts are documented and retained with the work order or transaction record.

4. Fees and Charges

4.1 Late Pickup Fee

Once a firearm is classified as Unclaimed, a one-time late pickup fee of $25 will be assessed.

4.2 Storage Fees

A storage fee of $10 per month applies after the firearm has been Unclaimed for the first full calendar month.

Storage fees are due on the first day of each month and continue to accrue until the firearm is lawfully disposed of.

5. Secure Storage and Recordkeeping

All Unclaimed and Abandoned firearms remain securely stored under controlled access.

Firearms remain logged in Clear Sky Armory’s Acquisition & Disposition (A&D) records until lawful disposition occurs.

6. Disposition of Abandoned Firearms

Once a firearm is classified as Abandoned, Clear Sky Armory may, at its sole discretion and in compliance with applicable law, take one of the following actions:

Return to Owner
The firearm may be returned to the original owner upon payment in full of:

    The original invoice amount and all accumulated late pickup and storage fees and satisfaction of all legal requirements for return or transfer.

    Transfer or Sale Through Lawful Dealer Processing

    The firearm may be transferred or sold only through lawful dealer processing, including any required background checks, waiting periods, and recordkeeping.

    Surrender to Law Enforcement

    The firearm may be surrendered to a lawful law enforcement agency, with proper documentation and A&D disposition.

      7. Prohibited Actions

      Clear Sky Armory will not:

      Dispose of any firearm outside lawful procedures
      Transfer ownership without required processing
      Destroy or part out a firearm except as permitted by law

      8. Acknowledgment

      This policy is incorporated by reference into customer work orders, service agreements, and sales documentation.

      Clear Sky Armory reserves the right to enforce this policy consistently and in accordance with all applicable laws and regulations.
