Customer Authorization & Liability Waiver Policy
1. Purpose
This policy establishes Clear Sky Armory’s requirements for customer authorization, disclosure, and liability acknowledgment prior to performing any gunsmithing, manufacturing, inspection, repair, modification, storage, or related firearm services. The purpose of this policy is to ensure clear customer consent, manage expectations, and reduce legal and safety risk while complying with federal and California law.
2. Scope
This policy applies to:
All firearms accepted by Clear Sky Armory for gunsmithing, repair, modification, inspection, manufacturing, storage, or evaluation
All customers delivering firearms to Clear Sky Armory
All owners, responsible persons, and employees involved in customer intake or firearms work
3. Requirement for Written Authorization
No firearms work will be performed without written customer authorization.
Authorization must be completed and signed prior to any diagnostic work, repair, modification, or test-firing.
Verbal instructions are not sufficient.
4. Customer Representations
By signing a work order or service agreement, the customer represents and affirms that:
They are the lawful owner or are legally authorized to possess and deliver the firearm.
The firearm was not delivered in violation of any law.
The information provided regarding the firearm is accurate to the best of their knowledge.
5. Disclosure of Firearm Condition and Risks
5.1 Existing Condition
Firearms may contain worn, modified, unsafe, or previously altered components.
Older, modified, or heavily used firearms may present unknown defects.
5.2 Risk of Damage or Failure
Gunsmithing and manufacturing work may reveal latent defects or cause breakage of worn or obsolete parts.
Replacement parts may be unavailable or require fabrication.
Clear Sky Armory is not responsible for pre-existing defects or failures not caused by negligence.
6. Authorization for Test-Firing and Function Testing
The customer authorizes Clear Sky Armory to conduct test-firing or function testing when necessary to diagnose, verify, or confirm safe operation.
Test-firing may occur at a lawful location using appropriate ammunition.
7. Estimates, Charges, and Approval
Estimates are provided when feasible and are not guarantees of final cost.
Diagnostic fees may apply regardless of whether repairs are authorized.
Additional work beyond the original scope requires customer approval.
8. Limitation of Liability
Clear Sky Armory is not responsible for:
Normal wear and tear
Pre-existing conditions
Manufacturer defects
Cosmetic changes inherent to necessary repair work
Liability, if any, is limited to the cost of the services performed.
9. Release and Indemnification
To the fullest extent permitted by law, the customer:
Releases Clear Sky Armory from claims arising from pre-existing firearm conditions or lawful gunsmithing activities.
Agrees to indemnify and hold harmless Clear Sky Armory from claims arising from the customer’s misuse or unlawful possession of the firearm.
10. Compliance With Law
All services are subject to federal, state, and local law.
Firearms will not be released until all legal requirements are satisfied.
11. Policy Incorporation
All key elements of this policy is incorporated by reference into all work orders, service agreements, and sales documentation.
12. Acknowledgment
By signing a work order or service agreement, the customer acknowledges that they have read, understand, and agree to this Customer Authorization & Liability Waiver Policy.
